AGREEMENT OF PHOTOGRAPHIC SERVICE
PHOTOGRAPHIC SERVICE
1.1 - On the wedding day, the photographic service provided by Lapela photographers begins at the time set previously with the clients.
Basic pack includes up to 7 hour service / Standard pack includes up to 10 hour work / Full pack includes up to 12 hour work (time periods are continuos).
If the clients want us to keep photographing after that period of time, the “extra hour” must be paid.
1.2 - The fees to be paid refer to the provision of the following photographic services previously agreed with the customer:
- Wedding day service, accompanies the bride and groom, with digital edition of the best photographs.
- Digital media delivery with all edited photos in high resolution, free of branding and watermarks, and free to use and duplicate. (No commercialization of the photographs will be provided by Lapela. The customer is the sole responsible for the distribution of the photographs through their respective family members and guests).
- Online gallery password protected available.
1.3 - Under normal conditions, the final photographic register to be delivered must include a minimum of 600 images, with no limitations in number or at additional costs. Of course the more hours we work, the more situations we photograph, the more photos we deliver. We would like to point out that the choice of the finest photographs to edit is an exclusive choice of the photographers. Digital negatives (RAW files) will not be provided.
PRICE, PAYMENT TERMS and PRODUCT
2.1 - To guarantee our services, a confirmation deposit of 200€ must be done.
2.2 The payment will be made as follows: 200 € for the confirmation deposit, and remaining amount closer to the wedding day.
2.3 - Failure to pay the agreed amount does not require Lapela to conclude the delivery of the final work.
2.4 – As the customer signing below, you confirm that you are knowledgeable of the work and artistic endeavors by Lapela Photography and of their published work, therefore confining total creative freedom to the photographers.
2.5 - The captured photographs will be subjected to an editing process in Adobe Lightroom (selection, exposure, color and contrast adjustments, minor corrections, etc) which are considered part of the independent creative work mentioned in point 2.4. Depending on our work load and time of the year, you should have a waiting period in-between up to 4 months after the wedding date to get your photographs. We will deliver all the best photos taken, in hi-resolution JPEG format (RAW files will not be delivered).
2.6 – Lapela Photography shall only report to the contractor(s), not allowing third-party interference.
2.7 – The customer(s) agree to authorize the publication of the photographs subjected to this agreement, for promotional purposes of Lapela Photography on the website: lapelafotografia.com, and on social media. In other specific situations, authorization will always be requested to customers.
2.8 - During service, if a lack of security exists or any act of violence (verbal, physical or otherwise) is to be perpetuated on a professional of Lapela Photography, the service will be promptly terminated, not fitting in this case, any claim for compensation by both parties.
3 - In case of cancellation by the bride and groom, the amounts received will not be returned.
3.1 - In case of failure to provide by Lapela Photography - for health or other reasons of force majeure - in which both photographers will be impeached to work, the amount received will be refunded in full. Similarly, in the unlikely event that only one photographer can be present to render service on the wedding day, the base price will be reduced by 25%. Keep in mind that Lapela will do everything it can to replace the absent professional with another photographer with a similar artistic sensibility and quality.
MISCELLANEOUS
4.1 - Lapela Photography is not responsible for photographs that might go uncaptured due to lack of time, organization, difficulty of access to certain places/locations, or that have not been previously requested. Also, we are not obliged to photograph at the request of another person(s) other than the customer(s) who sign this agreement.
4.2 - Lapela Photography is entitled to a pause of 30 minutes for a proper meal at the venue (in the case of standard or full pack), simultaneously with the meal of the bride and groom, this being a courtesy of the married couple. If not, Lapela team have the right to stop the service and go out to find some alteranative.
4.3 - The photos will be backed up in external hard drive discs for a maximum period of two years. To request a 2nd copy of the product, no added value will be charged. After this period, Lapela Photography will have no further liability or responsibility to its former customers.
If both parties are in perfect agreement over the above statements in this document, there is therefore an obligation to fulfill what is denominated by filling in below and submitting to Lapela.
